Terms of Use

1. Acceptance

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Notice of Medical Data Practices. If you do not agree, do not use the Service.

2. Eligibility

You must be 13 years of age or older to use Fursan Core. If you are between 13 and 18 years of age, you represent that you have your parent or legal guardian's permission to use the Service. The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13 without verifiable parental consent, we will delete it.

3. Not Medical Advice; Contraindicated Uses

Fursan Core provides general wellness, nutrition, fasting, and training information for personal informational purposes only. It is NOT a medical device, NOT software-as-a-medical-device under FDA guidance, and the AI Coach features DO NOT provide medical advice, diagnosis, treatment, or recommendations for any disease or condition. The Service is not intended to be used in lieu of consultation with a qualified healthcare provider, and no output of the Service should be relied upon as a substitute for medical care.

Do NOT use the Service if you are: (a) currently managing or recovering from a diagnosed eating disorder; (b) pregnant, recently postpartum, or breastfeeding; (c) taking medication where caloric, fluid, or electrolyte intake interactions matter (including but not limited to insulin, lithium, ACE inhibitors, ARBs, SGLT2 inhibitors, diuretics, anticoagulants, antiarrhythmics, lithium-affecting drugs); (d) managing chronic kidney disease or any condition affecting electrolyte balance; (e) managing diabetes mellitus where carbohydrate counting or fasting requires clinical supervision; (f) under 18 without active parental supervision; (g) experiencing a medical emergency. The Service has not been designed, validated, or tested for these populations, and any output you receive is not appropriate for them.

If you experience symptoms requiring medical attention, including chest pain, fainting, difficulty breathing, suicidal ideation, signs of severe dehydration, hypoglycemia, or any other emergency, stop using the Service immediately and call your local emergency number or qualified medical care.

You assume all risk for any decision you make based on Service output, and you agree to consult a qualified healthcare provider before starting any diet, fasting, supplementation, training, or behavior-change program informed by the Service.

4. Account & Security

You are responsible for keeping your account credentials confidential, for protecting any device on which you use the Service, and for all activity that occurs under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms, that we believe in good faith are compromised, or that we are required to suspend by law.

5. Your Content

You retain ownership of the data and content you submit ("User Content"), including food logs, training data, body metrics, photos, voice transcripts, and any medical or laboratory documents you choose to upload. You grant Fursan Health a limited, worldwide, non-exclusive, royalty-free license to store, process, transmit, display, and analyze your User Content solely for the purpose of providing and improving the Service to you. We do not sell your User Content. We do not use your User Content to train artificial-intelligence models, except where you explicitly opt in to a feature that the Service identifies as model-training.

6. Acceptable Use

You agree not to: (a) reverse engineer, decompile, or attempt to extract source code; (b) resell, sublicense, or repackage the Service; (c) use the Service to violate any law or any third-party right; (d) upload malicious code, malware, or any payload intended to interfere with the Service's operation or other users' data; (e) use automated tools, scrapers, or bots to access the Service except as expressly authorized in writing; (f) attempt to defeat any rate limit, security control, authentication mechanism, or access restriction; (g) impersonate another person, misrepresent your identity, or use someone else's account; (h) use the Service to provide medical advice or clinical decision support to any third party.

7. AI & Third-Party Providers; Pre-BAA Notice

Some Service features rely on third-party AI providers, nutrition databases, payment processors, email providers, and wearable integrations. We disclose the currently active providers in the Privacy Policy. When you invoke an AI feature, your prompt content and relevant account context will be transmitted to the configured AI provider for processing. You can opt out of all AI features at any time via Settings → Privacy & Consent.

Pre-BAA notice. Fursan Health is in the process of executing Business Associate Agreements ("BAAs") with our AI providers and other subprocessors. Until those BAAs are executed and you receive in-product notice that BAA-eligible processing has been enabled for your account, the AI provider's standard terms apply to your prompt data, including any data-retention and use-for-service-improvement provisions in the AI provider's terms. You should not include identifiable medical information, identifiable diagnostic data, or identifiable third-party information in any AI prompt unless you have read and accepted the active AI provider's terms.

AI accuracy disclaimer. AI outputs are generated by statistical language models. They may be incorrect, incomplete, outdated, or fabricated ("hallucinated"). They are not reviewed by a clinician before delivery. You must independently verify any AI output before acting on it.

8. Intellectual Property

All software, designs, names, marks, code, layouts, copy, and visual assets associated with Fursan Core are owned by Fursan Health, LLC, except where a third-party component is identified otherwise. The Service and all related rights remain the property of Fursan Health, LLC; you receive only the limited, revocable, non-exclusive, non-transferable right to use the Service as these Terms allow. Nothing in these Terms transfers ownership of any intellectual property right to you.

9. DMCA / Copyright Notices

If you believe that material on the Service infringes your copyright, send a notice complying with 17 U.S.C. §512(c)(3) to our designated agent at copyright@fursanhealth.com. The notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and its location on the Service; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; (f) a statement under penalty of perjury that the information is accurate and you are authorized to act on the copyright owner's behalf.

10. Termination

You may delete your account at any time from Settings → Privacy & Consent → Delete account, which will erase your User Content within seven days of the request as described in the Privacy Policy (subject to limited retention for legal, audit, or fraud-prevention purposes). We may suspend or terminate access if you breach these Terms, if we are required to do so by law, or to protect the security and integrity of the Service. Sections 3 (Not Medical Advice), 5 (license to User Content), 7 (AI providers), 8 (IP), 9 (DMCA), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 16 (Governing Law), and 17 (General) survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, EXCEPT WHERE PROHIBITED BY APPLICABLE LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FURSAN HEALTH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND FREEDOM FROM ERRORS OR INTERRUPTIONS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA YOU SUBMIT WILL BE PRESERVED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER FURSAN HEALTH NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF FURSAN HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) ONE HUNDRED U.S. DOLLARS ($100) OR (b) THE FEES YOU PAID TO FURSAN HEALTH FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

EXCEPT THAT NOTHING IN THIS SECTION 12 LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, FRAUD, WILLFUL MISCONDUCT, OR PERSONAL INJURY WHERE PROHIBITED BY LAW (INCLUDING WITHOUT LIMITATION CALIFORNIA CIVIL CODE SECTION 1668). Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this Section may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Fursan Health, its affiliates, and their respective officers, employees, agents, and contractors from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service in violation of these Terms or any law; (b) your User Content; (c) your violation of any third-party right; (d) any harm caused to a third party by your use of Service output. Fursan Health reserves the right, at its expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate in asserting any available defenses.

14. Force Majeure

Neither party will be liable for failure or delay in performance to the extent caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, public-health emergencies, labor disputes, internet outages, hosting-provider failures, or third-party infrastructure failures.

15. Changes to These Terms

We may update these Terms from time to time. Material changes that affect your privacy rights, the categories of data we process, our processing purposes, our liability limits, or your dispute-resolution rights will require your affirmative re-acceptance before continued use of the Service. Non-material changes (clarifications, typo fixes, contact information updates) will be announced in-product with the updated Effective date and continued use after the announcement constitutes acceptance.

16. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them are governed by the laws of the State of Delaware, without regard to its conflicts-of-law principles. The exclusive jurisdiction and venue for any action permitted under these Terms shall be the state and federal courts located in the State of Delaware, and you consent to the personal jurisdiction of those courts.

17. General

Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.

Entire Agreement. These Terms, together with the Privacy Policy and the Notice of Medical Data Practices, constitute the entire agreement between you and Fursan Health regarding the Service and supersede all prior agreements or understandings on the subject.

No Third-Party Beneficiaries. Nothing in these Terms creates rights for any third party.

Assignment. You may not assign or transfer these Terms or any right under them without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

No Agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship.

Notices. We may give notices to you in-product, by email to your account email, or by posting on the Service. You may give notices to us at the contact addresses listed below.
